TERMS OF USE OF BELBA M. & Co. G.P. DIGITAL MEDIA
The general partnership under the name “BELBA M. & Co.” hereafter referred to as “BTH PUBLICATIONS” in short – in the context of the consolidation of all its websites, offers its services under the following terms of use, which the visitor/user of these web pages is requested to carefully read and visit/use them only if he fully accepts these pages/services in their entirety.
PREAMBLE
BTH PUBLICATIONS provides the visitors/users of its websites with a rich collection of services, pages, options and/or resources, including various communication tools, e-commerce services, electronic areas of public access and communication between users, services/pages of personal nature and content. The pages of its websites include all forms of advertising. The already existing and any new services included in the future are subject to these terms of use, which apply to all digital sites belonging to BTH PUBLICATIONS and govern the entirety of services they provide. The visitor/user of the services understands and accepts that the entirety of pages/services is provided “as is” and BTH PUBLICATIONS waives any liability related to the limited duration, deletion, poor performance or failure to store any data of users and/or any content of personal pages/services.
BTH PUBLICATIONS has the uncontrolled discretion to modify, at any time, the contents of the websites it owns, to repeal their provided services and/or to create new ones without the prior notification of guests/users and without requiring the respective amendment of the present terms. The visitor/user is responsible for access to the services and relevant access may require the payment of fees to third parties (e.g. internet service providers, internet billing time). For such access, BTH PUBLICATIONS has no liability, both technically and in terms of any fees payable in any form. The visitor/user has the sole responsibility for the payment of the relevant fees. Also, the visitor/user is solely responsible for his personal equipment with the necessary technological means that allow access to services and websites of BTH PUBLICATIONS.
The present Terms of Use include the Privacy Policy, which explains the management of personal data of guests/users according to the Greek legislation on the Protection of individuals from the Processing of Personal Data (L. 2472/1997, as in force following the amendments that have taken place).
REGISTRATION
If the visitor/user wishes to register with the service/s of BTH PUBLICATIONS, where a single registration will provide access to all its internet sites, he/she agrees to: a) provide true, accurate, current and complete information about the details requested of him/her in relevant applications for access to the Unified User-Guest Profile of BTH PUBLICATIONS and the specific contents/services and b) maintain and thoroughly update his/her registration details in order to keep them true, accurate, valid, current and complete. In this Unified Profile, the guest/user will indicate whether he/she wishes to receive informative material from BTH PUBLICATIONS alone or not.
USER – GUEST ACCOUNT
BTH PUBLICATIONS provides—through its websites—its users with membership services, following the acceptance of the terms of use and completion of their detail registration process. Once the guest/user completes the registration process, he/she will receive confirmation of an access password and user name, appointed by him/herself. Users remain solely responsible for all acts performed under their personal password, user name, and user account in general. Users agree to immediately notify BTH PUBLICATIONS of any unauthorized use of their account and any carried out and/or potential security breach. Also, users are solely responsible for the careful use of their account and their logout from their account at the end of each usage period. BTH PUBLICATIONS is not responsible for any damage or injury resulting from the inability of users/guest to respect and follow this clause. After creating the account, its deletion is not possible.
OBJECTION RIGHT
The guest/user has the right to object (according to Art. 13 of L. 2472/1997) concerning the registration of personal data and, with a relevant request to the Website, request the correction or deletion of his/her personal data as well as his/her deletion as member of the Website. Such request shall be submitted through electronic message in the communication form of the respective Website and in accordance with the provisions of these terms. The Website shall respond within fifteen (15) days.
USER/GUEST ETHICS
It is mutually agreed and understood that, although BTH PUBLICATIONS provides its users/members with the necessary technological infrastructure and means for posting/publishing content, all information, data, text, graphics, photographs, images, music files, videos, messages and all content, whether publicly posted or privately transferred, remains the sole responsibility of the natural or legal entity from which the content originates. This means that the user is solely responsible for any and all content he/she posts, publishes, sends, transfers or otherwise makes available via the services of BTH PUBLICATIONS. BTH PUBLICATIONS cannot, due to its volume, control all content posted by its users on the services of the website, so does not guarantee the accuracy, integrity, legality or quality of such content. The user understands and accepts that by using the services of BTH PUBLICATIONS, he/she may be exposed to content that is offensive, indecent or illegal. Under no circumstances will BTH PUBLICATIONS be held responsible for any errors or omissions in any content or for any loss or damage resulting from the use of any content posted, sent, transferred or otherwise made available by users/members on the services of BTH PUBLICATIONS. In the event that BTH PUBLICATIONS becomes aware of the fact that any content causes moral damage or other damage to any third party, it reserves the right to immediately delete such content and simultaneously cease the operation of the account of the user violating the terms hereof.
The users agree not to use the services of BTH PUBLICATIONS for:
- Posting, publishing, sending, transferring or use of other methods for installing content that is unlawful, harmful, threatening, abusive, detrimental, defamatory, vulgar, violent, abusive, racist or otherwise objectionable, violating the personality and personal data of others, causes feelings of hatred and/or any other penal offense.
- Harming minors in any way.
- Impersonating any legal or natural entity or false statement on the identity of the user/member or misleading statement regarding the relationship and/or cooperation of the user/member with another natural or legal entity.
- Counterfeiting or other alteration of the identification of users/members with the purpose of misleading as to the origin of content transmitted through the services of BTH PUBLICATIONS.
- Posting, publishing, sending, transferring or using other methods to install content from a person not entitled to supply that particular content by law or by fiduciary relationship.
- Posting, publishing, sending, transferring or using other methods to install software or content of any kind (text, image, audio, video, animation) that infringes on any intellectual property rights of any carrier (including trade secrets).
- Posting, publishing, sending, transferring or using other methods to install unsolicited or unauthorized advertisement or other promotional content, sending unsolicited emails and any other promotion of unsolicited content.
- Posting, publishing, sending, transferring or using other methods for installing and/or promoting and/or supplying content that contains software viruses or any other electronic code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or equipment or telecommunications equipment.
- Interference or disruption of services or servers or networks connected to the services of BTH PUBLICATIONS, or disobeying the conditions, procedures and rules of use of these networks.
- Violation, with or without intent, of any local, national, European or international legislation and/or any regulation having legislative force and concerning and/or covering any service of BTH PUBLICATIONS.
- Harassment, in any manner, of the private life and individual and social rights of other users (such as the collection and/or storage of personal data of other users). The user of BTH PUBLICATIONS understands and accepts that BTH PUBLICATIONS perform no preliminary checking of content, but that BTH PUBLICATIONS and its competent associates reserve the right (but not the obligation) of the exclusive option to deny the posting/publishing or transfer or deletion of any content that is available through the services of BTH PUBLICATIONS. Also, BTH PUBLICATIONS and its competent associates reserve the right to delete any content that violates these terms of use. The user understands and accepts that he/she must evaluate and be responsible for any risk involved in the use of any content, including any decision he/she makes to rely on the accuracy, completeness and/or usefulness of any content. In this sense, the user understands and accepts that he/she cannot rely on the content created by BTH PUBLICATIONS or submitted for posting on it, including information available on the websites of BTH PUBLICATIONS, user pages and all other services of BTH PUBLICATIONS. The user understands and accepts the international nature of the Internet and commits to respect and faithfully uphold the local ethics rules of each country. In particular, the user commits to strictly complying with the legislation concerning the transmission of data from Greece and Europe to third countries.
PROVISION OF AUTHORIZATION FOR ADVERTISING PURPOSES
The user making use of the services of BTH PUBLICATIONS for posting and/or publishing information, data, text, graphics, photographs, images, music files, videos, messages, authorizes BTH PUBLICATIONS, for as long as this content is part of the services of BTH PUBLICATIONS, to use the space where it has been posted for advertising purposes. Also, the user posting and/or publishing information, data, text, graphics, photographs, images, music files, videos, messages, consents to the posting and/or publishing of advertisements from BTH PUBLICATIONS on the relevant pages/services. BTH PUBLICATIONS holds no responsibility for the communication of the guest/user with third party service providers advertised on its websites, as well as for any commercial transaction which may arise from the relationship between them.
DAMAGE – COMPENSATION
The user of BTH PUBLICATIONS understands and accepts that he/she has the exclusive responsibility to compensate BTH PUBLICATIONS and its partners for any legal dispute arising between it and third parties because of the content that he/she provides for posting, publishing, or other transfer through the services of BTH PUBLICATIONS.
COMMENCEMENT – CESSATION OF OPERATION OF SERVICESTΟΥΡΓΙΑΣ ΥΠΗΡΕΣΙΩΝ
BTH PUBLICATIONS reserves the right to modify and/or cease, temporarily or permanently, part or all of its services with or without prior notice to users. ATTENTION: A member’s account is automatically deleted after the lapse of 12 months of non-use of any service. After deletion, the “User ID in BTH PUBLICATIONS” is released, and can thus be taken by any new member – user.
DURATION
The user understands and accepts that BTH PUBLICATIONS reserves the exclusive right to discontinue the use of the password/s in its services and/or discontinue the availability of content to users who it considers to have violated the letter and spirit of these terms of use.
ADVERTISING
BTH PUBLICATIONS has no responsibility for the user’s communication with third party service providers advertised on BTH PUBLICATIONS and any commercial transaction that may arise from the relationship between them.
INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS – TRADEMARKS
Apart from the expressly mentioned exceptions (intellectual rights of third parties, partners and carriers), the entire contents of BTH PUBLICATIONS contained in all its websites, including images, graphics, photographs, texts, provided services and all the files of that website in general, comprise its intellectual property, registered trademarks and service marks of BTH PUBLICATIONS and are protected by the relevant provisions of Greek law, European law and international conventions and treaties. Consequently, none of these may be wholly or partially sold, copied, modified, reproduced, republished or uploaded, transmitted or distributed in any way. The exception to the above is the case of individual storage of a single copy of part of the content on a simple personal computer, for personal and not public or commercial use and without deletion of its indication of origin from BTH PUBLICATIONS, without in any way affecting the respective intellectual and industrial property rights. All other products or services mentioned on the electronic pages of this node and carry the marks of the respective organizations, companies, collaborating carriers, associations or publications, constitute their own intellectual and industrial property and therefore these carriers bear the relevant responsibility. The user understands and accepts that he/she has no right to reproduce, copy, sell, resell and/or commercially exploit all or part of the content of BTH PUBLICATIONS in any manner.
LIMITATION OF LIABILITY
Given the nature and volume of the Internet, under any circumstances, including negligence, BTH PUBLICATIONS is not responsible for any kind of damage suffered by the guest/user of the pages, services, options and contents of BTH PUBLICATIONS to which he/she navigates on his/her own initiative. The contents of BTH PUBLICATIONS are provided “as is” without any warranty, in any way expressed or implied. To the fullest extent under the law, BTH PUBLICATIONS disclaims all warranties, expressed or implied, including, but not limited to, those which involve the marketability and suitability for a particular purpose. BTH PUBLICATIONS does not guarantee that the pages, services, options and contents will be provided without interruption, errors or that the errors will be corrected. Also, BTH PUBLICATIONS does not guarantee that the same or any other related site or servers, through which they are made available to users/members, are free of viruses or other harmful elements. BTH PUBLICATIONS does not in any way guarantee the accuracy, completeness or availability of contents, pages, services, choices or their results. The cost of any potential corrections or services is borne by the guest/user and not in any case by BTH PUBLICATIONS.
EXCLUSION OF RESPONSIBILITY FOR INFORMATION/ADVICE
The content and information included in BTH PUBLICATIONS constitutes an offer to the guest/user of BTH PUBLICATIONS and the community of Internet users in general and shall not in any circumstances be considered as valid information and/or advice, nor does it conceal any instigation for the attempt or not of specific actions under any circumstances. BTH PUBLICATIONS undertakes the collection, processing and distribution of its content, without however guaranteeing the integrity, completeness, adequacy and generally the appropriateness and the absence of any errors in any case, particularly due to its large volume and the participation of third parties (natural or legal entities) during its primary production and collection. Consequently, the guests/users of BTH PUBLICATIONS, using its services on their own initiative, undertake the relevant responsibility of cross-checking the provided information.
LINKS TO OTHER WEBSITES
BTH PUBLICATIONS does not check the availability, content, policy of protection of personal data, the quality and completeness of other websites and pages referred through links, hyperlinks or advertising banners. Therefore, for any problem arising during their visit/use, the user must directly address the respective websites and pages, which bear the entire responsibility for providing their services. BTH PUBLICATIONS will in no way be deemed to embrace or accept the contents or services of websites and pages referred to or that it is linked to them in any other way.
E-COMMERCE
BTH PUBLICATIONS provides guests/users with the ability to purchase services and/or products through e-commerce applications in accordance with the specific terms expressed by it and ensuring the protection of personal data submitted for the use of these services. BTH PUBLICATIONS is not responsible for the quality of goods acquired through e-commerce applications and the transaction binds only the guest/user and the provider of goods or services. Consequently, in no case can BTH PUBLICATIONS be involved in a relevant litigation arising from this transaction. In cases where e-commerce applications are carried out between users/members and BTH PUBLICATIONS, BTH PUBLICATIONS is obliged to comply with the decision Z1-496/2000 on remote sales and the provisions of Law 2251/1994 on the Protection of Consumers. BTH PUBLICATIONS is thus required to inform its prospective customers regarding a) the essential characteristics of the goods and/or services offered, b) the price, c) the quantity and the cost of transport, d) the value added tax, if not included in the price, e) the method of payment, f) the method of delivery and execution, g) the period of validity of the offer or price and h) the right of withdrawal. The access to the pages/services of BTH PUBLICATIONS does not entail any additional cost beyond the current tariff scheme for general access to the Internet as formulated by relevant providers (ISPs) and paid to them only.
EXPRESSION OF OPINION
BTH PUBLICATIONS provides guests/users of its services with the opportunity to express their opinion on current matters expressed in the form of questions. The answers of the participants are recorded, analyzed and commented by BTH PUBLICATIONS in order to draw conclusions on the trends of public opinion in relation to the particular matter that was put to a vote. BTH PUBLICATIONS reserves the exclusive right to collect and exploit this data and the conclusions to which it is driven constitute its intellectual property.
APPLICABLE LAW AND OTHER TERMS
The above terms and conditions of use of BTH PUBLICATIONS, as well as any amendment thereto, are governed and supplemented by Greek law, European Union law and relevant international treaties. Any provision of the above terms coming against the law ceases to apply ex officio and is removed hereof, without in any way affecting the validity of the other terms. This constitutes the entire agreement between BTH PUBLICATIONS and the guest/user of its pages and services and binds only them. No amendment to these terms will be considered or be made part of this agreement, unless expressed in writing and incorporated therein.
